Chain of Responsibility

The duty is to act, and the proof is a record

If you run heavy vehicles in Victoria you sit under the Heavy Vehicle National Law, and Chain of Responsibility reaches past the driver to the people whose decisions shape how the vehicle is operated. The duty is to eliminate or minimise risk so far as is reasonably practicable. The practical test, on the day something goes wrong, is whether you can show what you actually did.

We are not your compliance adviser and we will not write your safety management system. What we can tell you is that nearly all of the evidence now lives in software, and software that is unmanaged, unbacked up or reachable by people who should not reach it is a weak place to keep evidence.

Three environments, one business

Each of these needs a different answer

The office

Allocations, accounts, customer rates and the transport management system. This is the part that looks like ordinary business IT, and it is where invoice fraud lands, because you issue a lot of invoices to customers who expect them.

The depot

A yard, a workshop, a weighbridge, cameras, sometimes a demountable with its own connection. Usually the least managed part of the business and the one most likely to be running equipment installed by somebody who was not an IT company.

The cab

Phones and tablets running driver, navigation and telematics apps, used by people who will not raise a ticket and will find a workaround instead. Devices need to be managed so company data can be removed when a driver or a subcontractor moves on.

The access nobody closes

Transport runs on flexible capacity, which means a steady flow of people and operators who need access to your systems for a season, a contract or a run, and should lose it afterwards. Where that removal is somebody's memory rather than a process, it does not happen, and the account list grows a long tail of people who have not worked for you in years.

It is one of the easier things to fix permanently, and one of the few where the fix also reduces what you are paying in licences.

Where we work

Agile IT Solutions has been based in Mornington since 2007.

A number of the operators we look after run out of depots around Dandenong, where a good share of the state's freight starts its day. IT questions from transport operators

Do you support our transport management or telematics system?

We do not write it and we are not its consultant. We take responsibility for everything underneath it: the platform, the data, the backups, the devices and the connectivity that reach it, and the vendor relationship when something needs escalating. When the fault sits in the application, we deal with that vendor rather than handing you back a ticket number.

Our drivers use their own phones. Is that acceptable?

It can be, provided the company part is managed separately from the personal part, so your data and your apps can be removed when a driver finishes without touching anything of theirs. What does not work is the common arrangement, where job photographs, delivery evidence and customer details sit in a personal gallery or a personal account. That becomes a problem the day somebody leaves, which is why it tends to stay unresolved.

Who is responsible for our compliance records?

You are, and we are not going to suggest otherwise. Our responsibility is the systems those records live in: that they are managed, backed up, restorable, retained for as long as you have decided, and reachable only by the people who should reach them. We will also tell you plainly when a record you rely on is sitting somewhere fragile, because that is a conversation worth having before an investigator asks for it rather than after.

Connectivity at our depot is poor. Can that be improved?

Usually, and the answer is rarely the one the retail provider offers. Depots are often in industrial areas with limited fixed services, so the practical approach is to look at what is actually available at that address, including fixed wireless and mobile broadband as a primary or backup service, and design something that keeps the site working when one path fails. We will tell you what it costs and what it will realistically deliver before anything is ordered.

We keep getting emails about changed bank details. How exposed are we?

More than you would like, because you issue and receive a high volume of invoices with businesses who expect them. The controls that stop it are ordinary: multi-factor authentication on every account, monitoring for mailbox rules and forwarding nobody set deliberately, alerting on unusual sign-ins, and a firm rule that any change to bank details is verified by phone on a number you already held.
